Legislation Overview

Title: CRIM CD-FIREARM OFFENSES

Description: Amends the Criminal Code of 2012. Enhances the penalties for unlawful use or possession of weapons by felons, unlawful possession of a firearm by a street gang member, and unlawful sale or delivery of firearms when the violation involves a machine gun or a firearm with a large capacity ammunition feeding device. Defines "large capacity ammunition feeding device" and "machine gun", and "streetgang member". Provides that a person also commits unlawful sale or delivery of firearms when the person knowingly: (1) sells or gives a firearm to a person who has been convicted of a felony or who is a streetgang member or (2) sells or gives a firearm that has been purchased or acquired out of state to a person who has been convicted of a felony or who is a streetgang member. Amends the Unified Code of Corrections. Provides that a period of probation, a term of periodic imprisonment, or conditional discharge shall not be imposed for a second or subsequent conviction for unlawful sale or delivery of firearms when the offense involved a person knowingly: (1) selling or giving a firearm to a person who has been convicted of a felony or who is a streetgang member or (2) selling or giving a firearm that has been purchased or acquired out of state to a person who has been convicted of a felony or who is a streetgang member.
